RASK represents client in dispute with ARIB over EU aid requirements.

Case

RASK consulted the Härjanurme Manor in a court dispute with the Estonian Agricultural Registers and Information Board (ARIB). The dispute arose over the results of an administrative compliance review, according to which our client had failed to submit data in the format required by the ARIB. The ARIB decided that the client had deliberately violated the law, and therefore significantly reduced the support for agricultural practices granted to the client.

The dispute focused on the provisions of the relevant European Commission regulation, the purposefulness of the direct payments from the European Agricultural Guarantee Fund (EAGF) and, consequently, on the justification, necessity and proportionality of the financial correction.

After the court of first instance ruled in favour of our client, the ARIB waived further legal action and made the direct payments from the EAGF.
