Siret Saks writes on debts of the deceased in a special issue of Äripäev

In an Äripäev special issue on apartment associations published on 17 October, Siret Saks, head of practice in family and inheritance law at RASK, writes about the accrual of an apartment owner's debt to an apartment association after the owner's death in situations where the association has no one to contact to settle the debt.

Succession proceedings and related disputes tend to be a protracted process. In her article, Siret outlines a number of statutory rights that apartment associations have that can be helpful in such situations. For example, if the proceedings to identify the successors have not been initiated, this can be done by the apartment association itself by submitting a notarised request. During the proceedings, the apartment association is entitled to receive information on who has accepted or renounced their inheritance. If it becomes apparent that the succession proceedings will be delayed, the association may request the court to apply measures for the management of the estate and to appoint an administrator of the estate.
